Overview

The University is committed to providing a safe and accessible environment to every person who is on the University's premises. These rules provide for the land, traffic and parking regulations that apply to every part of University premises.

1. Preliminary

1.1 These Rules apply:
(a) within the boundaries of University premises and to every part of University premises and
(b) to every person who is at any times on University premises

2. Definitions

Act means the University of the Sunshine Coast Act 1998.

Authorised person means an authorised person within the meaning of the Act.

Penalty unit has the meaning given by the Penalties and Sentences Act 1992.

Security officer means an authorised security officer within the meaning of the Act.

Staff means both academic and general members of staff.

Statute means any statute made under the Act.

Student means a student who was enrolled and registered in.

University premises means buildings and like structures, land and vehicles which are under the control and management of the University and which are used for, or in connection with, the purposes of the University.

Vehicle has the meaning given by the Transport Operations (Road Use Management) Act 1995 and includes any vessel.

Vice-Chancellor means the Vice-Chancellor within the meaning of the Act.

3. Responsibility

The Vice-Chancellor may appoint an authorised person to exercise any or all of the Vice-Chancellor's authorities and functions under these Rules other than the authority to make regulations under these Rules.

4. Land Rules

4.1 The Vice-Chancellor may authorise the erection, installation, placing, or display on University premises of such signs, signals, marks, notices, structures and devices as the Vice-Chancellor considers necessary or desirable for the purpose of:
(a) regulating or controlling traffic on the University premises, including the parking of vehicles, and the regulation and control of vehicles picking up or setting down passengers or loading or unloading goods
(b) regulating or controlling any other activity on University premises

4.2 The University will not be liable for any loss or damage suffered by or caused to any person, vehicle (or its accessories or contents) or property whilst travelling, standing or parked on University premises.

4.3 The Vice-Chancellor may declare any part of the University premises closed to all persons or to any person or to any class of persons, for such period as the Vice-Chancellor thinks fit.

4.4 Subject to the Act and these Rules, it is an offence for a person:

(a) to be on University premises in contravention of a declaration by the Vice-Chancellor under the Act or any other statute
(b) to contravene or fail to comply with a requirement or a direction of an authorised person or a security officer under the Act or these Rules
(c) except with the express written authority of the Vice-Chancellor:

(i) to bring, or keep or consume or cause to be brought, kept or consumed, any intoxicating liquor on University premises
(ii) to remove, alter, deface, damage, or otherwise interfere with a control device, building, sign or other property or thing on University premises
(iii) to have in their possession, carry or discharge, any firearm
(iv) to have in their possession, set off, or throw, any firework
(v) to kindle or make any fire or
(vi) to throw or discharge any stone or other missile

(d) except with the express written authority of the Vice-Chancellor in relation to the posting of notices on noticeboards provided for the purpose, or the distribution of matter in the course of lawful and customary University or student activities:

(i) to post, stick up or otherwise affix to any part of University premises, or otherwise give out or distribute, any placard, handbill, notice, advertisement, or other written, printed, stencilled or graphic matter or
(ii) to write, draw, print, paint on or otherwise deface any part of University premises

(e) except with the express written authority of the Vice-Chancellor:

(i) to sell, expose or offer for sale, lease, or hire or solicit orders for the purchase, lease or hire, of any goods, wares or merchandise, or other article or thing or
(ii) to organise, arrange, advertise, manage, or control, any fete, picnic, concert, display (including displays of film or television), or like gathering or performance on University premises

(f) to smoke inside or within ten (10) metres of any building or structure on University premises or in designated non-smoking area

(g) to throw, deposit, or leave on University premises any rubbish, refuse, paper, bottles, cigarette butts or other litter of any kind, except in a receptacle provided for the purpose

(h) to use insulting, abusive, threatening, profane, indecent, or obscene language or behave in a riotous, violent, disorderly, indecent, obscene, offensive, threatening, or insulting manner, on University premises

(i) except where incidental to the lawful and customary activities of the University, its students or staff and with the express written authority of the Vice-Chancellor, to organise, arrange, advertise, manage, or control any meeting, conference, discussion, speech, preaching or ceremony on University premises

(j) to obstruct:

(i) any member of University staff or Police officer in the discharge of their duty or
(ii) any person in the exercise and enjoyment of any lawful activity whilst on University premises

(k) except in the performance of the person's duties or with the express written authority of the Vice-Chancellor:

(i) to cut, break, deface, pick, remove, destroy, or otherwise injure any flora on University premises or
(ii) to remove, damage, or interfere with, any stake or label on or near any flora on University premises

(l) except as an aid for a disabled person or in the course of the person's duties or in connection with an approved program of study to bring onto or keep on University premises any animal, bird, reptile, fish or insect

(m) to disturb, frighten, shoot or throw missiles at or otherwise attempt to capture or kill any bird, fish or other animal on University premises or

(n) to bet or wager or offer to accept a bet or wager or play cards for money or to engage in any form of gambling on University premises

Maximum penalty for Rule 4.4 offence - 10 penalty units.

5. The Vice-Chancellor may determine the conditions under which vehicles are brought onto and parked on University premises.

6. Parking Areas, Spaces and Permits

6.1 The University will declare the following parking area:
(a) staff parking
(b) student parking
(c) general parking

(refer to Campus Map).

6.2 The University will designate the following parking spaces:
(a) University vehicles
(b) visitor car parking
(c) delivery and service vehicles
(d) disabled parking
(e) tenants of University premises
(f) motorcycles

6.3 Parking of any vehicle in staff or student parking areas will be regulated by permits issued by the University.

6.4 The fees charged by the University (refer to Schedule below) may vary from time to time.

6.5 The issuing of a permit does not guarantee the availability of a parking space.

6.6 The following vehicles do not require a permit to park:
(a) bicycles
(b) delivery and service vehicles
(c) University vehicles
(d) vehicles in general parking areas
(e) motorcycles

7. Parking Rules

7.1 Parking of vehicles on University premises is permitted subject to the Act, these Rules and other Council determinations from time to time.

7.2 Subject to these Rules, it is an offence for a driver or person in charge of a vehicle:

(a) to contravene or fail to comply with any prohibition or requirement indicated by a control device

(b) without limiting the generality of subsection (a):

to park a vehicle in any area in which parking bays are marked or otherwise indicated, other than wholly within a parking bay; or
in the case of a motor cycle, motor scooter or bicycle, to park in a space which, notwithstanding that it is marked or otherwise indicated as a parking bay, is of a size appropriate for the parking of a 4-wheel vehicle

(c) to park a vehicle so as to obstruct other vehicles

(d) to park a vehicle on roads or elsewhere, other than within designated parking areas

(e) to park a vehicle in a parking area for which the person does not have authorisation

(f) to bring an unregistered vehicle onto University premises without the express written authority of the Vice-Chancellor.

Maximum penalty for a Rule 7.2 offence - 10 penalty units.

7.3 A person's act or omission does not constitute an offence under Rule 6.2 if the act or omission was directed or authorised by an authorised person appointed under the Act.

7.4 This section does not apply to the entry onto and use on University premises, of any emergency vehicle.

8. Traffic Rules

8.1 Subject to these Rules, except with the express written authority of the Vice-Chancellor it is an offence for a driver or person in charge of a vehicle:

(a) on joining a roadway from a parking area, to fail to give way to vehicles on the roadway

(b) to drive the vehicle onto any recreation area, nature strip, garden, lawn, footpath or other part of University premises which is not constructed for use by vehicles

(c) to drive the vehicle at a speed exceeding 20 km/hour or, on any part of University premises with respect to which a lower speed limit is indicated by a control device, that speed limit

(d) to drive the vehicle negligently or recklessly, or in a manner that is dangerous to or without due care and consideration for other users of University premises

(e) to drive the vehicle so as to cause excessive noise or

(f) to abandon the vehicle on University premises

Maximum penalty for a Rule 8.1 offence - 10 penalty units.

8.2 A person's act or omission does not constitute an offence under section 8.1 if the act or omission was directed or authorised by an authorised person appointed under the Act.

8.3 This section does not apply to the entry onto and use on University premises, of any emergency vehicle.

8.4 The use of vehicles on University premises is subject to the Act, these Rules and the usual rules and regulations under Queensland traffic legislation.

9. Proceedings for Offences

A proceeding for an offence against these Rules may be taken in a summary way under the Justices Act 1886.
